Appeal by the defendant from a judgment of the Supreme Court, Kings County (DiMango, J., at plea; D’Emic, J., at sentence), rendered October 20, 2009, convicting him of burglary in the second degree and petit larceny, upon his plea of guilty, and imposing sentence.
Ordered that the judgment is modified, on the law, by vacating the sentence imposed; as so modified, the judgment is affirmed, and the matter is remitted to the Supreme Court, Kings County, for resentencing.
As correctly conceded by the People, the defendant was improperly sentenced as a second violent felony offender. In
In 2000, the defendant pleaded guilty to attempted criminal possession of a weapon in the third degree as the sole count of a superior court information. Therefore, the defendant’s conviction of that crime, upon his plea of guilty, did not constitute a violent felony pursuant to Penal Law § 70.02 (1) (d). Consequently, the defendant should not have been sentenced as a second violent felony offender (see People v Dickerson, 85 NY2d at 872), and the matter must be remitted to the Supreme Court for resentencing (see People v Banuchi, 304 AD2d 402, 403 [2003]; People v Williams, 290 AD2d 570, 571 [2002]).
