People v. Holmes

A careful review of the record in this case is most convincing that there was not sufficient proof of force or fear of bodily harm to establish the crime charged in the information. For that reason, the trial court should have directed a verdict of not guilty.

The verdict of the jury and the judgment of the court based thereon should be vacated, and the respondent should be discharged.
