The foregoing opinion of BARNES, C., is adopted as the opinion of the court. The judgment of the circuit court is, accordingly reversed and the cause remanded with directions to set aside the nonsuit, and likewise the order upon the sheriff, for further proceedings not inconsistent with the opinion.
