DISSENTING OPINION. Being unable to agree to the affirmance of the judgment, I dissent from the opinions of my associates in granting the motion for rehearing of the State. Regarding the reversal of the judgment, as ordered in the opinion of the court rendered on the 19th of June last, as the proper disposition of the appeal, I, without writing further, express my adherence to the action of the court and the reasons therefor embraced in the opinion last mentioned.
