I concur in the opinion reversing the judgment of the lower court because of the error of that court in refusing the submission of the special issue discussed. I am not certain, however, that the facts as reflected by the record show any liability as against appellant railway company. But I am not sufficiently advised at this time to dissent from the view expressed on that point.
