Taking note of all the facts before the trial court and before this court, we are unable to escape the conclusion that the conditions at the time of his trial, portrayed by the record, were such as to render it improbable that the appellant could secure a fair and impartial trial in Terry county. The reasons for this conclusion are set out in the original opinion, and a restatement or repetition of them is deemed unnecessary.
The motion for rehearing is overruled.
