M'Kean, Chief Justice,

it was stated, that conformably to the act of Assembly, the Defendant, after judgment was given against him by a Justice, ought to enter into a recognizance instanter, with, a least, one good surety. He may afterwards withdraw his security, or appeal to the Common Pleas within the six days allowed by the act.
