State v. Warner, Unpublished Decision (11-8-1999)

I fully concur in the majority's analysis and disposition of appellant's first, third and fourth assignments of error. I further concur in the majority's disposition of appellant's second assignment of error. I write separately only to state although the prosecutor's remark does not rise to the level of plain error, it was a reference, albeit indirect, to the fact appellant did not testify; therefore, improper.
