|J respectfully concur in the result. I would resolve this case by deciding whether the facts alleged support a charge of malfeasance in office (La. R.S. 14:134). I agree that violation of the Code of Governmental Ethics may form the basis for this charge, but I believe it is unnecessary to analyze the substance of the underlying statutes, La. R.S. 42:1112(B)(1) and La. R.S. 42:1111(E)(1).
