Sanderson, J., concurring specially :

I concur in the judgment and in what has been said by the Chief Justice, except so far as he implies that the plaintifl was in the actual and peaceable possession of the land upon which he had erected his house. I do not think “he was peaceably in the actual possession” of any portion of the premises, within the meaning of the statute in relation to forcible entries.
