10 UPON DUE CONSIDERATION, IT IS HEREBY ORDERED, ADJUDGED
11 AND DECREED that the judgment of the United States District
12 Court for the Eastern District of New York be AFFIRMED.
13 Appellant appeals from a judgment of the United States
14 District Court for the Eastern District of New York (Azrack,
15 Mag. J.), which imposed sanctions against Robert Drucker and
16 RxUSA, jointly and severally, in the amount of $100,000. We
17 assume the parties’ familiarity with the underlying facts,
18 the procedural history, and the issues presented for review.
19 Sanctions for fraud are warranted if it is “established
20 by clear and convincing evidence that [Defendant] has
21 ‘sentiently set in motion some unconscionable scheme
22 calculated to interfere with the judicial system’s ability
23 impartially to adjudicate’ the action.” Scholastic, Inc. v.
24 Stouffer, 221 F. Supp. 2d 425, 439 (S.D.N.Y. 2002) (quoting
25 Aoude v. Mobil Oil Corp., 892 F.2d 1115, 1118 (1st Cir.
26 1989)), aff’d 81 F. App’x. 396, 398 (2d Cir. 2003).
27 Falsifying evidence is sanctionable conduct. Ostano

1 Commerzanstalt v. Telewide Sys. Inc., 794 F.2d 763, 768 (2d
2 Cir. 1986). Submitting falsified evidence is also properly
3 sanctionable. See Scholastic Inc., 221 F. Supp. 2d at
4 440-441, aff'd 81 F. App’x at 398.
5 The record in this case supports the district court’s
6 findings of fact that Appellant Drucker falsified and
7 falsely authenticated falsified evidence and that Appellants
8 relied upon and submitted the falsified evidence in
9 connection with a motion for summary judgment. Appellant’s
10 actions constitute sanctionable conduct, and the district
11 court did not abuse its discretion by imposing sanctions in
12 this case.
13 For the foregoing reasons, the judgment of the district
14 court is hereby AFFIRMED.
