I respectfully dissent for the reasons stated in my dissent from the majority’s holding in City of. Philadelphia v. Middleton, 89 Pa. Commonwealth Ct. 362, *352A.2d (1985). I .would affirm the trial court’s order sustaining the City of Philadelphia’s preliminary objections.
