J., having presided in the court below, and Pece, J., being a tax-payer in tbe defendant town, did not sit; but after judgment they expressed their concurrence with the views stated in tbe opinion. Kellogg, J., who was upon the bench, and heard tbe case when first argued, entertained tbe same views.
