Prim v. City of Shreveport

(dissenting):

The majority opinion fails to properly apply the principles set forth in Ferguson v. HDE, Inc., La., 270 So.2d 867 (1972). The doctor testified Prim suffered a “cerebral vascular accident”. Prim worked .until the day he visited the physician diagnosing his disability.

It is my opinion the evidence preponderates he suffered “violence to the physical structure of the body” during the course and scope of his employment.

I respectfully dissent.
