It i s petitioners' contention t h a t individuals
appointed t o f i l l j u d i c i a l vacancies must r u n f o r o f f i c e a t the
n e x t succeeding primary.

VII, S e c t i o n 8, 1972 Montana C o n s t i t u t i o n , i s ambiguous.
The t h r u s t o f t h e c o m p l a i n t i s t h a t s e c t i o n s 9 3 - 7 1 0
and 93-711 a r e u n c o n s t i t u t i o n a l . The b a s i s f o r t h e c o n t e n t i o n s
i s considered l a t e r i n t h i s Opinion.
Respondents i n i t i a l l y c o n t e n d p e t i t i o n e r s l a c k s t a n d -
ing t o invoke the j u d i c i a l power o f t h i s C o u r t . I n addition,
r e s p o n d e n t s c o n t e n d t h e mandates of A r t i c l e V I I , S e c t i o n 8, as
t o j u d i c i a l v a c a n c i e s a r e unambiguous and t h e r e f o r e n o t
s u b j e c t t o any c o n s t r u c t i o n by t h i s C o u r t .
The f i r s t i s s u e i s w h e t h e r p e t i t i o n e r s h a v e s t a n d i n g
t o invoke the Court's j u d i c i a l power.
The r u l e i s w e l l - e s t a b l i s h e d i n M o n t a n a t h a t o n l y
t h o s e who a r e a d v e r s e l y a f f e c t e d b y a s t a t u t e w i l l b e h e a r d

Chovanak s t a t e d t h a t a s a g e n e r a l r u l e , private
c i t i z e n s may n o t r e s t r a i n o f f i c i a l a c t s when t h e y f a i l to
a l l e g e a n d p r o v e damages t o t h e m s e l v e s d i f f e r i n g i n c h a r a c t e r
f r o m t h a t s u s t a i n e d by t h e general p u b l i c .
The r i g h t t o v o t e , however, i s a p e r s o n a l and
constitutional right. A l t h o u g h s t a t u r e as an e l e c t o r w i l l
g e n e r a l l y n o t a l l o w an i n d i v i d u a l t o b r i n g an a c t i o n i n v o k i n g
t h e j u d i c i a l power, a n e l e c t o r who i s d e n i e d t h i s r i g h t i s
s u f f i c i e n t l y affected t o invoke the j u d i c i a l power t o
c h a l l e n g e t h e v a l i d i t y o f t h e A c t which d e n i e s him t h e r i g h t .
The s e c o n d i s s u e i s w h e t h e r t h e j u d i c i a l nominating
p r o c e s s as e s t a b l i s h e d i n Montana i s c o n s t i t u t i o n a l . Article
VII, S e c t i o n 8, 1972 Montana C o n s t i t u t i o n , i s divided
i n t o three subsections. Subsection (1) provides f o r the
n o m i n a t i o n and a p p o i n t m e n t t o f i l l j u d i c i a l v a c a n c i e s and i s
the constitutional b a s i s f o r s e c t i o n s 93-71 0 and 93-71 1 .
S u b s e c t i o n s ( 2 ) and ( 3 ) p r o v i d e t h e manner of the election t o

Article VII, S e c t i o n 8, subsection ( I ) , states i n
part: " E a c h n o m i n a t i o n s h a l l be c o n f i r m e d b y t h e s e n a t e , but
a n o m i n a t i o n made w h i l e t h e s e n a t e i s n o t i n s e s s i o n s h a l l b e
effective a s an a p p o i n t m e n t u n t i l t h e end o f the next
session."
There i s n o t h i n g anbiguous about t h i s language.

d e s i r e , t h i s C o u r t would h a v e t o i n s e r t l a n g u a g e i n t o s u b s e c t i o n
