I dissent.
I would grant the writ for the reasons expressed by Mr. Justice Vallée in the opinion prepared by him for the District Court of Appeal in Borgward v. Superior Court (Cal.App.), 325 P.2d 137.
Petitioner’s application for a rehearing was denied November 19, 1958. Schauer, J., and McComb, J., were of the opinion that the application should be granted.
