Limon, Member FINAL ORDER ¶1 The appellant has filed a petition for review of the initial decision, which dismissed his involuntary resignation appeal for lack of jurisdiction. Generally, we grant petitions such as this one only in the following circumstances: the initial decision contains erroneous findings of material fact; the initial decision is based on an erroneous interpretation of statute or regulation or the erroneous application of the law to the facts of the case; the administrative judge’s rulings 1 A nonprecedential order is one that the Board has determined does not add significantly to the body of MSPB case law. Parties may cite nonprecedential orders, but such orders have no precedential value; the Board and administrative judges are not required to follow or distinguish them in any future decisions. In contrast, a precedential decision issued as an Opinion and Order has been identified by the Board as significantly contributing to the Board’s case law. See 5 C.F.R. § 1201.117(c). 2 during either the course of the appeal or the initial decision were not consistent with required procedures or involved an abuse of discretion, and the resulting error affected the outcome of the case; or new and material evidence or legal argument is available that, despite the petitioner’s due diligence, was not available when the record closed. Title 5 of the Code of Federal Regulations, section 1201.115 (5 C.F.R. § 1201.115). After fully considering the filings in this appeal, we conclude that the petitioner has not established any basis under section 1201.115 for granting the petition for review. 2 Therefore, we DENY the petition for review and AFFIRM the initial decision, which is now the Board’s final decision. 5 C.F.R. § 1201.113(b). ¶2 The appellant challenges the administrative judge’s conclusion that the Board lacks jurisdiction over his involuntary resignation appeal. Petition for Review (PFR) File, Tab 1 at 4-8. An appellant is entitled to a jurisdictional hearing if he makes a nonfrivolous allegation 3 of Board jurisdiction. Ferdon v. U.S. Postal Service, 60 M.S.P.R. 325, 329 (1994). Here, we discern no basis to disturb the administrative judge’s conclusion that the appellant failed to nonfrivolously allege that he qualified as an “employee,” as defined under 5 U.S.C. chapter 75. 4 Initial Appeal File (IAF), Tab 15, Initial Decision (ID) at 7-9; see Winns v. U.S. Postal Service, 124 M.S.P.R. 113, ¶ 8 (2017) (explaining that only an “employee,” as defined under 5 U.S.C. chapter 75, can appeal an adverse action to the Board), aff’d sub nom. Williams v. Merit Systems Protection Board, 892 F.3d 1156 (Fed. Cir. 2018); see also Robinson v. Department of the 2 Because we so find, we need not address the timeliness of the appellant’s petition for review. 3 A nonfrivolous allegation is an assertion that, if proven, could establish the matter at issue. 5 C.F.R. § 1201.4(s). 4 For instance, there is no indication that the appellant was serving an initial appointment pending conversation to the competitive service or, even if he was, that he was not serving a probationary or trial period at the time of his purportedly involuntary resignation. See 5 U.S.C. § 7511(a)(1)(C)(i); see also Martinez v. Department of Homeland Security, 118 M.S.P.R. 154, ¶ 6 (2012). 3 Army, 102 M.S.P.R. 546, ¶ 9 (2006) (indicating that, in order for the Board to have jurisdiction over an involuntary resignation claim, an appellant must meet the definition of “employee” under 5 U.S.C. § 7511). Thus, a different outcome is not warranted. ¶3 The appellant asserts that the administrative judge failed to consider his claim of familial status discrimination. PFR File, Tab 1 at 8. We disagree. Indeed, the administrative judge addressed this claim, explaining that, to the extent the appellant was alleging marital status discrimination, 5 such an allegation did not warrant a different outcome because the appellant was in the excepted service. ID at 7 n.4; see Barrand v. Department of Veterans Affairs, 112 M.S.P.R. 210, ¶ 13 (explaining that 5 C.F.R. § 315.806, which provides a regulatory right of appeal when an appellant claims marital status discrimination, applies only to individuals in the competitive service). ¶4 Accordingly, we affirm the initial decision. 6 NOTICE OF APPEAL RIGHTS 7 You may obtain review of this final decision. 5 U.S.C. § 7703(a)(1).
